SUBJECT II – REGULATIONS AND COMPLIANCE
As a responsible provider of fireworks products, we prioritize safety and legal compliance in all aspects of our operations. Understanding and adhering to regulations governing the purchase, possession, and use of fireworks is crucial for ensuring a safe and enjoyable experience. Here are comprehensive guidelines to consider:
Comprehensive Consultation: Prior to engaging in any fireworks-related activities, it is paramount to conduct a comprehensive consultation with state, county, and local authorities to gain a thorough understanding of the specific regulations governing fireworks in your area. While fireworks legality may vary at the state level, it is important to recognize that individual counties or cities may impose additional restrictions or requirements to ensure safety and compliance with local ordinances.
To initiate this consultation process, we strongly encourage reaching out to your local fire department or municipal office, as they possess valuable knowledge and insights into firework laws and regulations that are tailored to your specific location. These authorities can provide crucial information regarding permissible fireworks types, designated usage areas, permissible dates and times for discharge, and any additional permits or licenses required for fireworks-related activities.
It is essential to recognize that compliance with fireworks regulations extends beyond state-level statutes, and local ordinances may impose additional constraints or stipulations. By proactively engaging with local authorities, you can obtain clarity on the legal framework governing fireworks usage in your area and ensure that your activities are conducted in full adherence to applicable laws and regulations.
Furthermore, it is incumbent upon individuals to take the initiative to educate themselves about any additional requirements or restrictions imposed by their town, city, or state before placing orders for fireworks. By assuming this responsibility and conducting due diligence, individuals can avoid potential legal repercussions and ensure that their fireworks-related activities are conducted safely, responsibly, and in full compliance with applicable regulations.
Permit Procurement: Understanding and adhering to the permit application process is paramount in ensuring legal compliance and safety when purchasing, possessing, and using fireworks. Many jurisdictions mandate the acquisition of permits for such activities, underscoring the need for individuals to familiarize themselves with local permit requirements and procedures.
Before planning any fireworks events or purchases, it is imperative to research the specific permit regulations governing your area. This may involve contacting local government agencies, fire departments, or law enforcement authorities to obtain comprehensive information on permit applications, deadlines, and associated fees.
Initiating the permit application process well in advance of any planned fireworks events is highly recommended. This proactive approach not only allows sufficient time for processing but also demonstrates your commitment to legal compliance and responsible behavior. Additionally, obtaining permits early mitigates the risk of last-minute complications or delays that could jeopardize your event or purchase.
Failure to secure the necessary permits can have serious legal ramifications, including the imposition of fines, penalties, or the confiscation of fireworks. By diligently adhering to permit requirements, individuals can mitigate these risks and ensure that their fireworks activities are conducted within the bounds of the law.
Ultimately, obtaining permits serves as a critical safeguard against legal liabilities and reinforces the importance of conducting fireworks-related activities safely and responsibly. By prioritizing permit procurement and compliance, individuals demonstrate their commitment to fostering a culture of legal accountability and safety within their communities.
Agreement Acknowledgement: When you initiate a purchase with our company, you explicitly agree to hold us harmless from any legal implications arising from the possession, distribution, or use of fireworks. This agreement is a fundamental aspect of our transaction process and underscores your acknowledgment of personal responsibility for ensuring legal compliance with all permit regulations and safety protocols.
By placing an order with us, you affirm that you have obtained all necessary permits and approvals required by law for the lawful possession and use of fireworks in your jurisdiction. This includes, but is not limited to, permits for transportation, distribution, and discharge of fireworks as mandated by local, state, and federal regulations.
It is imperative to understand that our company cannot assume responsibility for any legal implications or consequences resulting from the misuse, unauthorized handling, or improper storage of fireworks. As a customer, you bear sole responsibility for ensuring that all fireworks-related activities are conducted in accordance with applicable laws and safety guidelines.
Furthermore, you acknowledge that any failure to comply with permit regulations, safety standards, or other legal requirements may expose you to potential legal consequences, including fines, penalties, or civil liabilities. Our company disclaims any liability for such outcomes and emphasizes the importance of strict adherence to all regulatory mandates.
We encourage all customers to prioritize legal compliance, safety awareness, and responsible behavior when engaging in fireworks-related activities. By adhering to these principles, you not only protect yourself from legal risks but also contribute to the promotion of safety and accountability within the fireworks community.
Personal Responsibility and Safety Awareness: As individuals, it is paramount to acknowledge the dual nature of fireworks – while they can undoubtedly provide entertainment and celebration, they also inherently entail risks that necessitate responsible handling and awareness. At our company, we prioritize safety above all else and emphasize the critical importance of exercising caution and adhering to stringent safety guidelines throughout every stage of fireworks use.
Proper handling, storage, and ignition procedures are fundamental aspects of ensuring the safe enjoyment of fireworks. It is imperative to meticulously follow manufacturer instructions and best practices to minimize the risk of accidents and injuries. This includes storing fireworks in a cool, dry place away from heat sources or flammable materials, handling them with care to prevent damage or mishaps, and using appropriate ignition devices and techniques to initiate fireworks displays safely.
Moreover, safety awareness extends beyond individual precautions to encompass a collective responsibility to educate oneself and others about safety protocols and emergency procedures. This includes understanding the potential hazards associated with fireworks use, such as burns, eye injuries, and fires, and knowing how to respond effectively in the event of an accident or emergency.
By prioritizing safety awareness and education, individuals can significantly mitigate the risks associated with fireworks use and ensure that their celebrations remain enjoyable, memorable, and, above all, safe for all participants. We encourage our customers to familiarize themselves with safety guidelines, seek out resources and information on fireworks safety, and always exercise caution and vigilance when handling fireworks to promote a culture of safety and responsibility within their communities.
Legal Recourse and Accountability: It's crucial to understand the potential legal implications and accountability associated with non-compliance with regulatory requirements or incidents involving fireworks. Whether it's failure to obtain necessary permits, disregard for safety protocols, or mishaps during fireworks displays, individuals must recognize the seriousness of these matters and their potential consequences.
Failure to adhere to permit regulations or safety protocols can lead to a range of legal consequences, including fines, penalties, or civil liabilities. Local authorities and regulatory agencies are tasked with enforcing fireworks laws and regulations, and they may take legal action against individuals or entities found to be in violation of these rules.
Moreover, in cases where incidents occur due to negligence or misconduct, individuals may be held legally accountable for any resulting damages, injuries, or property loss. This could entail facing civil lawsuits, insurance claims, or criminal charges, depending on the severity of the situation and the extent of harm caused.
Given these potential legal risks, it's incumbent upon individuals to prioritize legal compliance and safety when engaging in fireworks activities. This includes obtaining all necessary permits, adhering to safety guidelines and best practices, and taking proactive measures to prevent accidents or mishaps.
Understanding and acknowledging the legal repercussions of non-compliance and incidents involving fireworks, individuals can make informed decisions and take appropriate precautions to safeguard themselves and others from harm while enjoying fireworks responsibly.
By embracing these comprehensive regulations and compliance guidelines, individuals can foster a culture of safety, responsibility, and legal accountability in their fireworks-related activities. We remain committed to promoting adherence to regulatory standards and supporting our customers in conducting safe and compliant fireworks events.
SUBJECT III – NEW HAMPSHIRE COMPLIANCE
In this comprehensive section, we delve into how our New Hampshire-based company meticulously adheres to state regulations regarding the shipping, purchase, possession, and use of fireworks. Operating within the regulatory framework of New Hampshire allows us to maintain legal compliance and foster safety standards for our valued customers.
New Hampshire State Regulations and Shipping: Our shipping policies are intricately crafted to align with the comprehensive regulations established by the state of New Hampshire concerning fireworks. These regulations cover various aspects, including permissible firework types, designated sales periods, and stringent safety requirements.
- Permissible Firework Types: New Hampshire regulations outline specific types of fireworks that are permitted for sale, possession, and use within the state. Our shipping practices strictly adhere to these guidelines, ensuring that only legally permissible fireworks are included in shipments to customers.
- Designated Sales Periods: While our operations span year-round, it's essential to note that New Hampshire permits the sale of fireworks throughout the year. However, if your state has seasonal restrictions, it is your responsibility to ensure that purchases are made within the legal sales window of your jurisdiction.
- Stringent Safety Requirements: New Hampshire maintains stringent safety requirements for the purchase, possession, and use of fireworks to mitigate potential risks and ensure public safety. Our shipping practices meticulously uphold these safety standards, including packaging protocols, handling procedures, and safety information provided to customers.
By aligning our shipping policies with the comprehensive regulations established by the state of New Hampshire, we ensure responsible usage and mitigate potential risks associated with fireworks shipments. Our commitment to legal compliance and safety underscores our dedication to providing a secure and satisfactory experience for our customers.
Age Restrictions for Shipping: Our commitment to safety and legal compliance is exemplified through the stringent age restriction enforced for the purchase and possession of fireworks via shipping. Before shipping any fireworks orders, we require customers to undergo Know Your Customer (KYC) verification to confirm their age and ensure compliance with regulatory requirements.
Despite potential variations in age requirements across different regions around the nation, our company maintains a steadfast policy requiring individuals to be 21 years of age or older to purchase and possess fireworks through shipping. This elevated age requirement surpasses those mandated in certain areas to maintain uniformity and promote responsible handling practices among our customers. By imposing this age restriction, we strive to ensure that only legally eligible individuals receive fireworks shipments, thereby upholding legal standards and safety protocols. Age verification procedures are rigorously implemented during the checkout process, where customers must provide valid identification confirming their age.
This meticulous approach ensures that our shipping practices align with regulatory guidelines and prioritize the safety and well-being of our customers and the community at large.
Purchase and Possession Guidelines in Shipping: When purchasing fireworks through shipping, customers are required to adhere to the established regulations in New Hampshire. This includes several key guidelines:
- Age Requirement: Individuals must be at least 21 years of age to purchase and possess fireworks. This age requirement is rigorously enforced to ensure compliance with legal standards and to promote responsible ownership practices. Age verification procedures are implemented during the checkout process to confirm that customers meet this requirement.
- Usage Restrictions: Fireworks purchased through shipping should only be utilized on the buyer's property or with explicit written permission from the landowner, in compliance with both our state regulations and any additional restrictions imposed by the customer's state, county, or city. This restriction is essential to prevent unauthorized use of fireworks and to ensure the safety of both individuals and property. Customers are expected to fully adhere to all local ordinances and regulations governing the use of fireworks in their area, without exception to our state regulations.
- Compliance with Local Laws: Customers must adhere to all applicable local laws and regulations, even when selecting shipping delivery. This encompasses understanding and abiding by any additional restrictions or requirements set forth by their city, county, or municipality. As regulations pertaining to fireworks often vary and are subject to change, it is imperative that customers take responsibility for familiarizing themselves with these laws before making a purchase.
By adhering to these purchase and possession guidelines, customers can help promote safe and responsible fireworks usage while ensuring compliance with legal requirements in New Hampshire.
SUBJECT IV – SHIPPING RESTRICTIONS
The company delineates various shipping restrictions associated with fireworks to uphold legal compliance, safety, and responsible handling practices. Customers must familiarize themselves with these restrictions to preempt potential complications or legal entanglements.
Geographic Restrictions: Geographic restrictions are in place to ensure that our shipping practices comply with the diverse laws and regulations governing the sale and transportation of fireworks. While we strive to offer shipping services to a wide range of locations, it's imperative to recognize that regulations can vary significantly from one area to another.
Certain states, such as Massachusetts, are known to have strict regulations prohibiting the shipping of fireworks. We diligently adhere to these restrictions and do not ship fireworks to locations where it is prohibited by state law. However, even in states where shipping fireworks is permitted, customers must understand that local regulations may further restrict or prohibit the possession and use of fireworks.
It is the responsibility of the customer to conduct thorough research and ascertain whether their local jurisdiction allows the shipping, possession, and use of fireworks. While we provide guidance and information through our shipping policies and customer service team, we cannot undertake this responsibility on behalf of our customers. Each customer must ensure that they comply with all relevant laws and regulations in their area before purchasing fireworks for shipping. This proactive approach empowers customers to make informed decisions and facilitates legal compliance with local regulations, ultimately promoting a safe and positive experience for all involved.
Age Restrictions: In accordance with legal standards, customers must be a minimum of 21 years old to purchase and possess fireworks. This age requirement applies universally to all orders placed for shipping, without exception. Our stringent enforcement of this restriction underscores our commitment to promoting responsible handling and usage of fireworks. For further details, please refer to our comprehensive terms of service.
Permit Requirements: While some jurisdictions may necessitate permits for the purchase, possession, and use of fireworks, it is imperative that customers ensure compliance with all relevant permit requirements within their area before proceeding to place an order for shipping. Failure to obtain the necessary permits could lead to legal ramifications, such as fines or confiscation of fireworks. Therefore, it is the responsibility of each customer to obtain the appropriate permit approvals from their state or local authorities prior to placing their order if that’s required.
Shipping Method Restrictions: It is imperative to recognize that certain shipping methods may be restricted or unavailable for the shipment of fireworks due to inherent safety concerns and regulatory constraints. As such, customers are advised to meticulously review the available shipping options presented during the checkout process to ascertain the most appropriate method for their specific order. Our comprehensive shipping policies provide detailed information regarding the available shipping methods, including any associated restrictions or limitations that may be imposed. It is essential for customers to thoroughly acquaint themselves with these policies to ensure compliance and mitigate any potential risks or complications associated with their chosen shipping method.
Quantity Limits: Our commitment to regulatory compliance and safety extends to the imposition of quantity limits on orders intended for shipping. These limits are meticulously established to prevent the unauthorized resale or distribution of fireworks, thereby ensuring strict adherence to legal requirements, and fostering a culture of responsible fireworks usage. Customers are strongly encouraged to thoroughly review the quantity limits outlined in our shipping policies prior to placing an order. By adhering to these limits, customers not only demonstrate their commitment to legal compliance but also contribute to the promotion of safe and responsible fireworks handling practices within their communities.
By adhering to these shipping restrictions, we aim to uphold legal standards, promote safety, and ensure a positive experience for our customers. It is essential for customers to review and comply with these restrictions to facilitate smooth and lawful transactions when purchasing fireworks for shipping.

Additionally, it's important to note that Fireworks Hubs™ generally offer a faster and more cost-effective alternative to home delivery, making them a preferred choice for many customers seeking timely and affordable shipping solutions.
Third-Party Pickup Location: Our shipping policy extends to include third-party pickup locations, offering customers an alternative method to collect their fireworks orders. This option is particularly advantageous for customers who are willing to travel to non-affiliated fireworks shops to retrieve their purchases. It's worth noting that, at present, all pickup locations, aside from our New Hampshire shop, are third-party establishments.
Pickup options at third-party locations are contingent upon the schedule and operating hours of the respective pickup points. Customers can explore this option during the checkout process if it is available in their area. However, it's important to understand that pickup availability is subject to the discretion and operational schedule of the third-party location.
While this option provides flexibility and convenience, it's essential to recognize that any transactions conducted at third-party pickup locations are not associated with our company. Customers should familiarize themselves with the operational details and policies of the specific pickup point they choose, ensuring a smooth and seamless pickup experience.
As with any shipped order, customers are bound by our strict shipping policies and terms and conditions. Customers are expected to adhere to our policies and fulfill their obligation to pick up their orders from the designated third-party pickup location.
Business Drop™ (Local Business Location): Our Business Drop™ service offers customers the convenience of designating a local business location for the pickup of their fireworks orders. This option streamlines the pickup process and provides added flexibility for customers who prefer collecting their purchases from nearby business establishments.

SUBJECT VI – SHIPPING OPTION DETAILS
When it comes to shipping your orders promptly and efficiently, choosing the right shipping option is paramount. To streamline this process, we offer distinct shipping options tailored to meet the diverse needs of our customers. Each option boasts unique features, benefits, and considerations, empowering you to select the most suitable method based on your preferences and requirements. Let's explore the intricacies of each shipping option to assist you in making an informed decision for your shipments.
Home Delivery: Also known as delivery to a residential address, provides the convenience of having your order shipped directly to your home, condo, apartment, or a business operating from a residential location. This option is favored by customers seeking ease of delivery. It's crucial to note that additional charges from the freight company may apply for home deliveries. These charges stem from the extra services required, such as navigating residential streets and delivering to individual homes. Consequently, the shipping cost for residential delivery may be slightly higher compared to deliveries to commercial addresses or freight terminals.
It's imperative to understand that residential delivery may add up to two or more additional days to the original estimated delivery time. This allowance is necessary to accommodate the freight carrier's scheduling, as they may need to adjust their routes to include residential deliveries. Freight companies typically adhere to 'last-mile' delivery practices and schedule delivery appointments accordingly.
When opting for home delivery, ensure you are available to sign for the delivery at the time of pickup. LTL freight carriers typically require a signature as proof of receipt for all deliveries. Failure to be available for receipt may result in a redelivery fee charged by the freight carrier. This fee, varying by carrier, is passed on to the purchaser. Customers should anticipate a delivery window when selecting home delivery. LTL freight carriers often provide a 4-hour delivery window for residential deliveries. This window allows customers to anticipate the approximate time of delivery and ensure someone is available to receive the shipment.
While Home Delivery offers the convenience of doorstep delivery, it's vital to be aware of potential additional charges, scheduling considerations, and the requirement for a delivery window. Understanding these factors empowers customers to make informed decisions when selecting the home delivery option for their shipments, mitigating potential legal issues and ensuring a smooth delivery process.
Fireworks Hub™: Also known as terminal pickup, is designed to provide customers with a convenient and cost-effective option for collecting their orders. We strive to locate the nearest terminal within a reasonable distance, typically ranging from 30 minutes to up to 90 minutes away from your location. However, please be aware that terminal locations are often situated on the outskirts of metropolitan areas, so if you reside in a rural area, the terminal may be slightly further away.
Once your order arrives at the designated pickup terminal, the freight company may reach out to inform you that it's ready for collection. This allows you to schedule a convenient time to retrieve your order, providing flexibility and ensuring a smooth pickup process.
Choosing terminal pickup offers several advantages. Firstly, it allows for flexibility in scheduling the pickup, enabling customers to select a convenient time to retrieve their orders. Additionally, terminal pickup can be more affordable and efficient, as it eliminates the additional costs associated with 'last-mile' delivery to residential addresses.
If you live near a terminal, opting for Fireworks Hub™ pickup may be the most practical and efficient choice for receiving your fireworks order. It ensures convenience while minimizing potential delays or extra expenses commonly associated with home delivery options.
Business Drop™: Also known as delivery to a commercial address, is tailored to meet the needs of individuals who may be associated with a business and opt to have their orders delivered to a commercial location. While there may be charges associated with deliveries to commercial addresses, these fees are typically lower compared to residential delivery options.
Unlike residential delivery, which may incur higher fees due to the specialized services required for delivery to individual homes, deliveries to commercial locations generally involve standard procedures and fewer additional costs.
However, it's important to note that while charges may apply for deliveries to commercial addresses, they are often more affordable compared to home delivery options. By selecting Business Drop™, individuals associated with businesses can enjoy the convenience of timely delivery at a lower cost, making it an attractive option for those looking to optimize their shipping budget without compromising on service quality.
SUBJECT VII – SHIPPING FEES
Our shipping fees and charges are automatically calculated during the checkout process, ensuring transparency and accuracy for our customers. When you place an order, the shipping cost displayed reflects the total amount you will pay for shipping based on the selected shipping method and destination.
Here's an overview of the shipping fees associated with each shipping method:
Home Delivery: The shipping fee displayed covers the standard cost of shipping to your designated residential address. This fee is calculated based on various factors, including the weight and dimensions of your order, as well as the distance to your delivery address. It encompasses the transportation of your fireworks order to your doorstep.
Please note that additional charges may apply if your delivery address is classified as a rural area by the freight carrier. Rural areas are typically defined as locations that are outside of major metropolitan areas or areas that are difficult to access due to geographical factors. The additional charges for rural delivery, if applicable, are determined by the freight carrier and may vary depending on the specific location.
Any extra shipping costs associated with rural delivery will be clearly outlined in the following section of the checkout process for your reference. These costs are transparently displayed to ensure that you are fully informed of any additional charges before completing your purchase. We strive to provide accurate and upfront pricing to our customers, allowing for informed decision-making and a seamless shopping experience.
Fireworks Hub™ (Terminal Pickup): The shipping fee displayed during checkout covers the cost of shipping your order to the designated Fireworks Hub™ terminal for pickup. It's important to understand that shipping hazardous materials, such as fireworks, incurs significant expenses due to safety regulations and handling requirements.
Despite the inherent costs associated with shipping hazardous materials, there are no additional charges such as liftgate need for terminal pickup. This makes Fireworks Hub™ terminal pick up a more affordable option compared to home delivery, as customers can avoid additional fees typically associated with ‘last-mile’ delivery to residential addresses.
While we strive to provide cost-effective shipping solutions, it's essential to recognize that ensuring the safe transportation of fireworks involves careful handling and compliance with regulatory standards. By choosing Fireworks Hub™ terminal pickup, you not only save on shipping costs but also contribute to the safe and responsible transportation of hazardous materials.
Third-Party Pickup Location: When opting for third-party pickup locations, you'll usually encounter this choice under the pickup options rather than shipping. This categorization is intentional, as we manage all the logistical complexities behind the scenes to offer you this convenient and cost-saving option.
At checkout, the shipping fee displayed encompasses the total amount you'll pay for shipping, with no additional charges commonly linked to third-party pickup locations. This streamlined process grants you the flexibility to retrieve your orders from nearby locations without facing extra fees, rendering it an appealing choice for numerous customers.
However, it's essential to note that the availability of third-party pickup locations may fluctuate based on the schedule and operating hours of these pickup points. Therefore, it's prudent to verify the availability of this option during checkout and confirm that the selected pickup location aligns with your preferences and convenience.
Business Drop™ (Local Business Location): The shipping fee displayed encompasses the cost of shipping to the specified local business location for pickup. As with Fireworks Hub™ pickup, there are no supplementary charges for utilizing the business drop service.
Our automated checkout system guarantees that the shipping fees presented to you are the definitive prices you will incur for shipping. Nevertheless, it's imperative to acknowledge that supplementary charges may be applicable for Home Delivery or Business Drop™ if your location is classified as rural by the freight carrier. These additional shipping expenses will be meticulously delineated in the subsequent section for your scrutiny.
Disclaimer: "Last mile" shipping refers to the final leg of the delivery process, where fireworks are transported from a distribution center or transportation hub to their ultimate destination, typically a residential or commercial address. This term is used to denote the final stretch of the delivery journey, often the costliest and logistically challenging phase due to the intricacies of navigating local neighborhoods, traffic congestion, and the need for specialized equipment or services to complete the delivery.
SUBJECT VIII – SHIPPING SURCHARGE POLICES
In circumstances where a disparity arises between the quoted shipping price and the actual cost charged by the freight carrier, adjustments may be deemed necessary. This situation may particularly arise with Home Delivery, although it can potentially occur with other shipping options as well, often due to the imposition of special restrictions by freight forwarding companies.
Should the variance between the quoted price and the carrier's charge exceed 15%, we reserve the explicit right to rectify the shipping cost accordingly. This corrective measure is implemented to ensure that any unforeseen circumstances or additional fees incurred during the shipping process are accurately reflected in the final cost to the customer.
While we maintain the discretion to determine whether or not to apprise you of any adjustments, it is imperative to underscore that transparency remains foundational in our shipping practices. Consequently, should we elect to augment your shipping cost, you will be promptly notified via email, phone, or alternative means prior to the shipment of your order. This proactive communication affords you the opportunity to make an informed decision concerning your shipment, empowering you to select an alternative shipping option or even opt to cancel the order if deemed necessary.
At the core of our shipping surcharge policies lies an unwavering commitment to fairness and integrity in all our dealings with customers. This policy embodies our steadfast dedication to fostering transparent and equitable shipping practices across our operations.
SUBJECT IX – DELIVERY TIMEFRAMES AND ESTIMATES
Understanding delivery timeframes and estimates is essential for ensuring timely receipt of your orders. At our company, we prioritize providing accurate estimations and transparent information regarding delivery timelines to facilitate a seamless shipping experience for our customers.
Home Delivery: When selecting home delivery, customers can typically anticipate receiving their fireworks within 8 to 12 business days from the date of order placement. However, it's crucial to acknowledge that delivery times may fluctuate, especially during peak seasons or periods of heightened order volumes, such as late May to late June and late November to early December. During these periods, delivery may be delayed due to increased demand and carrier limitations.
It's imperative to comprehend that we operate under the FOB origin shipping terms, meaning that once your order departs, we relinquish responsibility for any transit delays that may occur. Consequently, we do not provide guarantees for specific delivery dates for home delivery orders, as external factors beyond our control may impact the delivery process.
Customers who opt for expedited shipping can expect delivery 1 to 2 days earlier than the standard timeframe. This expedited option offers a quicker turnaround time for those seeking swifter delivery of their orders. Nonetheless, it's essential to remain cognizant that despite expedited shipping, external variables such as carrier delays or unforeseen circumstances may influence delivery times, thus warranting a cautious approach to expectations.
Fireworks Hub™& Business Drop™: Delivery timeframes for terminal pickup and business drop locations are subject to variation based on the chosen shipping method and the specific location of the pickup point.
Typically, customers can anticipate their orders being available for pickup within 7 to 10 business days from the date of order placement. However, it's important to acknowledge that transit delays may occur, especially during peak seasons or periods of increased shipping activity.
Similar to home delivery, we cannot guarantee specific delivery dates for terminal pickup or business drop locations. External factors such as carrier delays or high order volumes may impact delivery times, emphasizing the need for flexibility and understanding in the shipping process.
For customers opting for expedited shipping, delivery may occur 1 to 2 days earlier than the standard timeframe, offering a faster turnaround time for those seeking swifter delivery of their orders. However, it's essential to remain aware that even with expedited shipping, unforeseen circumstances or carrier delays may affect delivery times.
3rd Party Pickup: Delivery timeframes for third-party pickup locations may vary significantly based on the operating hours and schedule of the designated pickup points.
Customers should be aware that the availability of pickup times at third-party locations can be subject to change and may vary depending on factors such as seasonal demand, operating hours, or specific arrangements made with the pickup entity. Given this variability, it's essential for customers to check the pickup schedule and availability of their chosen third-party location when selecting this option.
SUBJECT X – TRACKING AND ORDER STATUS
Tracking your order and staying updated on its status is essential for ensuring a smooth delivery process. At our company, we provide multiple options for tracking your order every step of the way. Upon placing your order, you will receive a confirmation email containing your order details. Once your order has been processed and shipped, typically within 48 hours, you will receive another email containing your tracking number.
You can use this tracking number to monitor the status of your order directly on our website. Simply input the tracking number into the designated field on our tracking page, and you will be able to view real-time updates on your order's whereabouts and estimated delivery date.
Additionally, you can also track your order using the freight carrier's official website. By inputting the tracking number provided in the email, you can access detailed information on the transit status of your order directly from the carrier's platform.
We understand the importance of timely and accurate order tracking, which is why we strive to provide you with the necessary tools and information to monitor your shipment conveniently. If you have any questions or concerns regarding your order status, our customer service team is available to assist you every step of the way.
SUBJECT XI – FOB SHIPPING TERMS AND CONDITIONS
Our shipping practices are governed by Free On Board (FOB) terms, as recognized under international commercial law. These terms are designed to establish a clear and equitable framework for the transfer of ownership and responsibility of goods sold by us to you, the buyer.
Definition and Application of FOB Terms:
- FOB Explained: Free On Board (FOB) is a legal term that determines the point at which ownership and risk associated with the goods transfer from the seller (us) to the buyer (you). For our transactions, this transfer occurs the moment the goods are picked up by the shipping carrier from our facility or designated distribution points.
- Transfer of Ownership and Risk: Upon the carrier's collection of the goods, as designated by either party during the purchase process, you assume full ownership and responsibility for the goods. This includes all risks of loss or damage during transportation. By proceeding with the purchase, you acknowledge your acceptance of these terms and the inherent responsibilities as the new owner.
Selection of Freight Carrier: We work with well-established freight carriers to ensure the secure handling of your goods. However, should you prefer to engage your own freight carrier, you are welcome to do so. It is important to note that if you choose to arrange your own freight services, you must provide us with the necessary documentation confirming the carrier's assignment before the items leave our premises. This documentation must include, but is not limited to, a Bill of Lading or a shipping contract, which will serve as a record of the freight services you have commissioned.
Upon the dispatch of your items with the carrier of your choosing, and once the appropriate documentation is verified, the risk and responsibility for your goods are transferred to you. This transfer is in line with our Free On Board (FOB) shipping terms. By opting for your own carrier, you acknowledge and accept this transfer of risk and confirm that your carrier is acting on your behalf. Please ensure that your chosen carrier is fully informed of these FOB terms and is prepared to undertake the responsibilities that come with them.
Legal Acknowledgment and Acceptance of Terms
- Acceptance of Terms: By proceeding with any purchase from the Company, you, the buyer, are affirming your explicit and informed acceptance of our Free On Board (FOB) shipping terms. This acceptance is legally binding and indicates your consent to the transfer of ownership and assumption of risk as delineated by these terms, effective upon the goods' release to the carrier from our shipping point.
- Comprehensive Disclosure: We endeavor to provide complete and transparent disclosure of the FOB shipping terms to ensure that you are thoroughly informed of your legal rights and the obligations entailed. By agreeing to these terms, you acknowledge that you have been provided with, understand, and accept all conditions related to the shipping and handling of your goods.
- Responsibility for Risk: Once the goods have been picked up by the carrier, you accept full responsibility for all risk of loss or damage that may occur during transit. You agree that Apex Fireworks LLC shall not be held liable for any such loss, damage, or additional costs incurred once the goods have been successfully transferred to your chosen carrier.
- Confirmation of Understanding: Your decision to complete the purchase confirms that you have read, understood, and accepted these terms. You recognize that this agreement forms an integral part of the sales contract and serves as a conclusive understanding between you and the Company regarding FOB shipping responsibilities and risk allocation.
Limitation of Liability Clause:
- Termination of Liability: Upon the delivery of goods to the freight carrier, Apex Fireworks LLC's legal responsibility for those goods is fully relinquished. From this point forward, the Company is absolved from any liability for loss, damage, or additional costs that may occur during the transportation of the goods. The Company's obligations are thus fulfilled, and liability ceases in strict accordance with the agreed-upon FOB terms.
- Obligations of the Buyer: The buyer assumes all risks once the carrier takes possession of the goods. It is incumbent upon you to arrange for suitable insurance coverage to protect your interests during the shipping process. In the event of any transit-related loss or damage, the buyer is responsible for filing claims directly with the carrier. You agree to release and indemnify Apex Fireworks LLC from any subsequent claims or damages that may arise post-transfer to the shipping carrier.
- Insurance and Claims Process: We encourage you to verify the carrier's insurance policies or to obtain additional coverage to mitigate the risks of transport. Should you need to file a claim, you must adhere to the carrier's specified procedures. Apex Fireworks LLC will not assume responsibility for the buyer's non-compliance with these procedures or for not securing sufficient insurance.
- Acknowledgment of Risk Allocation: By accepting these FOB shipping terms, you acknowledge your understanding and agreement to the transfer of risk once the goods are under the carrier's control. This acceptance is recognized as an integral part of the contractual agreement between you and the company.
- Exclusion of Consequential Damages: We shall not be held responsible for any indirect or consequential damages that may arise from the shipping process. This includes losses such as profit, revenue, savings, or data, as well as any other incidental or punitive damages. This limitation applies even if the possibility of such damages has been communicated to us in advance.
- Force Majeure: The Company remains free from liability for delays or failures in shipment caused by events beyond our control. Such events may encompass natural disasters, acts of war or terrorism, government actions, pandemics, labor disputes, or significant transportation disruptions. Should such circumstances occur, our obligations will be suspended for the event’s duration without any breach of contract.
- Notification of Claims: Claims for loss or damage must be reported directly to the carrier at the time of delivery, with the driver present. The details of the claim must be clearly noted on the delivery receipt (BOL), and failure to do so may result in the waiver of any claims against us.
- Dispute Resolution and Governing Law: Disputes related to our shipping terms will be settled through binding arbitration in New Hampshire, adhering to its arbitration laws. The arbitration outcome will be final and binding. These terms are governed by New Hampshire law, which will preside over any disputes.
- Compliance with Laws: Buyers are responsible for ensuring that the transportation of their goods complies with all relevant laws and regulations concerning export and import. This includes obtaining necessary permits and licenses. Buyers also agree to indemnify us against any legal issues that arise from non-compliance with these laws.
- Inspection and Reporting: On receiving the goods, buyers must inspect the items thoroughly in the presence of the carrier's driver. Any issues observed must be reported immediately to the carrier and documented on the delivery receipt. It is also the buyer’s responsibility to inform us of these discrepancies. Acceptance of the goods without such documentation will be taken as acknowledgment that they have been delivered in good condition.
SUBJECT XII – REFUSUAL UPON DELIVERY
In accordance with our Free On Board (FOB) shipping terms, customers assume full responsibility for their order once it has been shipped. If a customer refuses delivery for any reason, they will still be responsible for all shipping costs, including the original shipping fee and the cost of returning the order to our facility. Refusing a shipment does not entitle the customer to a refund, and any shipping fees paid will not be reimbursed.
If a customer applied a cash credit or other promotional discounts toward their shipping cost and then refuses the delivery, the cash credit will be revoked and voided. Additionally, the customer will be charged for both the original shipment and the return shipping fee. For example, if a customer used $200 in cash credit toward their shipping cost and later refused the delivery, the $200 credit would be forfeited, and they would still be required to pay the full cost of both the outgoing shipment and the return shipping.
For orders designated for pickup at a Fireworks Hub™ location, it is the customer’s responsibility to ensure timely collection. If a customer fails to pick up their shipment within the required timeframe and the freight carrier returns the order to our facility, the customer will be responsible for both the initial shipping fee to the Fireworks Hub™ and the return shipping cost. Any cash credit or promotional discount used to cover shipping will be voided. If the customer requests a re-shipment of their order, they will be required to pay the full cost of both the return shipment and the new shipping fee before the order is re-sent.
If a shipment is damaged during the return process due to customer refusal or failure to pick up from a Fireworks Hub™, the damaged items will be properly disposed of, and no refund, store credit, or replacement will be issued. Fireworks, as hazardous materials, cannot be returned once shipped, and any refused shipments may be destroyed, disposed of, or returned to the terminal’s originating hub. Customers who abandon their shipments by failing to pick up their order or refusing delivery will not be eligible for any reimbursement, store credit, or replacement items.
If the refused shipment is returned to us undamaged, the customer will receive store credit for the value of the items, minus all applicable shipping fees, including both the initial shipping cost and the return shipping charge. If these fees exceed the total value of the order, the customer will be required to pay the difference before any future transactions can be processed. Store credit will not be issued for any promotional discounts, cash credit, or special offers that were used on the original order.
To prevent unnecessary charges and forfeiture of earned promotions, customers are encouraged to ensure they are available to receive or pick up their shipment. Once an order is shipped, the customer is responsible for all related shipping costs, even if they decide not to accept the delivery. It is important for customers to verify all details of their order before it is shipped to avoid complications, unexpected fees, or the loss of any applied promotional credits.
SUBJECT XIII – RETURNS AND EXCHANGES FOR SHIPPED ITEMS
The company understand the importance of customer satisfaction and strive to provide the best possible service. However, due to the unique nature of our business and the products we offer, we have implemented a strict no return or exchange policy.
Our commitment to safety and compliance with regulatory standards means that once fireworks or related items have been shipped, we are unable to accept returns or exchanges. This policy is in place to ensure the safety of our customers and the integrity of our products.
While we recognize that circumstances may arise where a return or exchange is desired, we encourage customers to review our Refund Policy page for more detailed information on our policies and procedures regarding returns and exchanges. This page outlines the specific criteria under which returns or exchanges may be considered, as well as any associated fees or requirements.
In the event that you have any questions or concerns about your order or our return policy, we encourage you to reach out to our customer service team for assistance.
SUBJECT XIV – PROCEDURES FOR LOST OR DAMAGED SHIPMENTS
This section outlines the protocol for reporting and managing lost or damaged goods in transit under the Free On Board (FOB) terms. The scope includes any goods shipped by the Company where the risk of loss or damage has transferred to the buyer upon the goods being loaded onto the carrier's transport at the shipping point.
Buyer’s Responsibility: Upon taking ownership of the goods at the FOB point, the buyer assumes full responsibility for the risk of loss or damage. The Company is not liable for goods that are lost, damaged, or delayed while in the possession of the carrier.
Notification Procedure: In the event of a lost or damaged shipment, the buyer must:
- Notify the carrier immediately upon discovery of the loss or damage.
- Document the damage with detailed notes and photographic evidence, if possible.
- Preserve all packaging materials and damaged goods for inspection by the carrier.
- File a formal claim with the carrier in accordance with their specified time frame and procedures.
Company’s Role in Claims Process:
- Assistance with Documentation: The Company commits to furnishing the necessary shipment documentation that may be required to substantiate a claim with the carrier. This includes providing copies of shipping records, bills of lading, and other relevant documents related to the transaction and shipment of the goods.
- Limitation of Involvement: It is expressly understood that the Company's role is limited to the provision of documentation only. The Company shall not serve as an intermediary in the claims process between the buyer and the carrier. All claims for lost or damaged goods are to be directly addressed and resolved by the buyer with the carrier in accordance with the carrier's claim procedures.
- No Obligation for Additional Support: While the Company may, at its discretion, offer support in the form of advice or guidance, there is no obligation for the Company to extend such support, and it does not constitute an ongoing commitment. Any assistance provided beyond the furnishing of shipment documentation is a courtesy and not an obligation.
- Potential Discretionary Remedies: Under certain circumstances, and at the Company's sole discretion, we may offer a goodwill gesture, such as a specified value of store credit, to mitigate the buyer's loss. However, such gestures are not guaranteed and do not create any legal liability for the Company or a precedent for future claims.
- Acknowledgment by Buyer: By engaging with the Company under these FOB terms, the buyer acknowledges and agrees that any assistance provided by the Company in the event of lost or damaged shipments is at the Company's discretion and does not constitute an obligation or liability on the part of the Company.
Limitation on Claims: The buyer must file any claims for lost or damaged goods in accordance with the carrier's specified time frame, which typically begins from the date of the scheduled delivery. This time frame is a strict deadline, and failure to initiate a claim within it may result in the forfeiture of the right to claim. The buyer should diligently review the carrier's terms upon receipt of goods to ensure full understanding of the process for filing a claim. The Company will provide guidance on locating these terms if requested, but it remains the buyer’s responsibility to be proactive in understanding and acting within the stipulated time frame set forth by the carrier. The Company cannot extend the carrier's deadlines nor influence the carrier's policies regarding the timeliness of claims.
Dispute Resolution: In the event of any disputes between the buyer and the Company concerning lost or damaged shipments under these FOB terms, both parties agree to seek resolution through the dispute resolution mechanisms as set out in the overarching shipping terms and conditions. This may include, but is not limited to, mediation, arbitration, or litigation, subject to the jurisdiction and laws of the State of New Hampshire. The process will be conducted in an impartial manner with each party bearing their own costs unless otherwise ruled by the governing law or the arbitration panel. It is intended that any dispute be resolved in a fair, timely, and cost-effective manner.
SUBJECT XV – SIGNATURE REQUIREMENTS AND DELIVERY AUTHORIZATION
Ensuring the security and proper receipt of goods is paramount to our service. This section delineates our policies regarding signature requirements upon delivery and options for delivery authorization. These protocols are established to secure the delivery process, guarantee that goods are received by authorized individuals, and offer flexibility for delivery preferences.
Signature Requirements: A signature from an authorized recipient at the delivery address is crucial for confirming the receipt of goods. Our approach includes:
- Direct Signature Required: All deliveries default to requiring a direct signature from the recipient. This measure is in place to ensure that goods are directly handed over to an authorized individual, minimizing the potential for loss or theft.
- Authorized Signatory: It is the buyer's responsibility to ensure that an authorized person is available to sign for the delivery. Any signature obtained at the delivery address will be accepted as proof of delivery and fulfillment of our delivery commitment.
Delivery Authorization: Understanding the need for flexibility, we provide the following options to accommodate different delivery preferences:
- Waiver of Signature: Buyers have the option to waive the signature requirement by submitting a clear, written authorization prior to the shipment. This decision absolves us of further responsibility for the goods once they have been delivered as directed.
- Alternative Delivery Instructions: Buyers can specify alternative delivery instructions should the need arise. These instructions must be provided in writing and prior to dispatch. We will strive to adhere to these instructions, though final compliance by the carrier is subject to their operational policies.
Consequences of Unauthorized Delivery Modifications: Modifications to the delivery process not pre-approved in writing may incur additional charges and elevate risk. The buyer assumes responsibility for any extra costs and any adverse outcomes stemming from such changes.
Dispute Resolution: Disputes related to delivery, including signature and authorization discrepancies, will be addressed through our standard dispute resolution process. This process is designed to ensure fair and timely resolution in line with our established terms and conditions.
Acceptance of Terms: By proceeding with a transaction, the buyer acknowledges and agrees to abide by these signature and delivery authorization policies. Compliance with these procedures is essential for maintaining the integrity and security of the delivery process.
SUBJECT XVI – ADDRESS VERIFICATION AND CORRECTIONS
In our ongoing effort to ensure the security of transactions and prevent fraudulent activities, we have instituted strict policies concerning the verification of billing and shipping addresses. Our primary aim is to ensure that all transactions are legitimate and that goods are delivered to the rightful owner without compromising security.
Requirement for Matching Addresses: As a standard security measure, we require that the billing address provided during the purchase process matches the shipping address. This policy helps to safeguard against unauthorized transactions and ensures that goods are dispatched to a verified location.
Verification Process for Non-Matching Addresses: We recognize that there may be legitimate reasons for the billing and shipping addresses to differ. In such cases, we will undertake additional verification steps to confirm the authenticity of the transaction:
- Request for Additional Documentation: Customers may be asked to provide further proof of address, such as a recent utility bill, bank statement, or other forms of identification bearing the name and address of the cardholder.
- Verification Call or Email: A representative from our company may contact the customer directly via phone or email to verify the details of the transaction and the authenticity of the provided addresses.
Corrections to Shipping Addresses: If a discrepancy or error in the shipping address is identified.
- Customer Notification: We will promptly notify the customer of the discrepancy and request clarification or additional information as needed.
- Holding Shipments: Shipments may be temporarily held until the address verification process is completed to our satisfaction. This is to prevent the mis delivery of goods and to ensure that the transaction is secure.
Consequences of Unverified Addresses: Transactions with addresses that cannot be verified through the provided documentation or direct contact may be subject to cancellation. This measure is taken to protect both the customer and our company from potential fraud.
Responsibility for Accurate Address Information: It is the customer's responsibility to ensure that all address information provided is accurate and complete. Customers are encouraged to double-check their details at the time of order to avoid delays in the verification process or potential cancellation of their order.
Acceptance of Verification Procedures: By making a purchase, customers acknowledge and agree to these address verification and correction procedures. Understanding and cooperating with these requirements facilitates a smooth transaction process and enhances the security of all parties involved.

SUBJECT XVIII – HOLIDAY SHIPPING SCHEDULES AND DEADLINES
During peak holiday periods, particularly around late May to early June and late November to early December, we experience a significant increase in-store shopping volume. This surge, combined with the operational limitations of our freight carriers, often impacts our ability to meet specific shipping deadlines. It is crucial for our customers to understand how these periods affect our shipping processes and what to expect in terms of delivery schedules.
No Guaranteed Shipping Dates: Given the unpredictability of shipping volumes and potential delays from our freight carriers during these peak periods, we are unable to guarantee delivery on specific dates. While we strive to process and ship orders as efficiently as possible, external factors such as increased freight traffic and operational constraints can lead to delays beyond our control.
Recommended Ordering Deadlines: To enhance the likelihood of receiving your orders in a timely manner, especially before major holidays, we provide recommended ordering deadlines. These deadlines are designed to allow ample time for processing and shipping, considering the expected delays during these busy periods. We strongly advise placing orders well in advance of these recommended deadlines to avoid potential disappointments.
Shipping Carrier Delays: Our reliance on external freight carriers for the delivery of orders means that we are subject to their operational schedules and constraints. During peak holiday periods, carriers may experience their own delays, which can impact delivery times. We ask for your patience and understanding as we and our freight partners navigate these busy times.
Order Processing Times: Please note that order processing times may also be extended during these peak periods due to the high volume of orders. We prioritize orders on a first-come, first-served basis and endeavor to process and ship each order as quickly as possible.
Customer Responsibility: Customers are encouraged to plan accordingly and place orders two to four months before peak seasons to minimize the impact of potential delays. Please ensure that shipping and contact information is accurate and up-to-date to facilitate smooth delivery and communication.
Adjustments to Shipping Methods: In some cases, we may adjust shipping methods to expedite delivery or avoid potential delays. Any changes to the shipping method will be communicated to the customer, and any differences in shipping costs will be transparently addressed.
Acknowledgment of Holiday Shipping Policies: By placing an order during these peak holiday periods, customers acknowledge and accept the potential for extended shipping timelines and the limitations regarding guaranteed delivery dates. We appreciate your patience and understanding as we work diligently to fulfill orders under these challenging conditions.
SUBJECT XIX – SHIPPING DOCUMENTATION
Ensuring transparency and facilitating a smooth delivery process are core aspects of our service commitment. To this end, we are dedicated to providing all necessary shipping documentation for each order, including but not limited to the Bill of Lading (BOL) for Less-Than-Truckload (LTL) shipments, and any other pertinent documents required for the transportation and receipt of goods.
Bill of Lading (BOL) for LTL Shipments: For every LTL order, we will provide a Bill of Lading, which serves as a critical document outlining the shipment details, including the type, quantity, and destination of the goods being transported. The BOL acts as a receipt for the shipment, a contract between us and the carrier, and often as a document of title for the goods.
Additional Shipping Documents: The thorough documentation of each shipment is a cornerstone of our shipping process, ensuring both regulatory compliance and customer satisfaction. For all orders, especially those involving regulated goods like fireworks, we provide comprehensive documentation tailored to the specifics of the shipment and carrier requirements. This documentation includes, but is not limited to:
- Packing Lists: We include detailed packing lists with every shipment, itemizing the contents of each package. This ensures that customers can easily verify the receipt of all items in their order and facilitates the accurate and efficient processing of shipments at their destination.
- Hazardous Materials Documentation: Given the nature of our products, shipments containing regulated goods are accompanied by necessary hazardous materials documentation. This includes safety data sheets (SDS) and other relevant information outlining proper handling instructions, safety measures, and emergency response guidelines to ensure the safe transport and handling of these items.
- Carrier-Specific Documentation: Depending on the carrier's requirements and the specifics of the shipment, we may provide additional documentation as needed. This could include special labels or forms required for the transportation of hazardous materials within domestic networks.
SUBJECT XX – SHIPPING INSPECTION
To ensure the integrity and quality of our products upon arrival, we have established a comprehensive shipping inspection protocol. This process is designed to empower our customers to verify the condition of their goods upon receipt and to address any concerns related to shipping or handling damages promptly.
Inspection Upon Delivery: Customers are strongly encouraged to inspect their shipment upon delivery. This inspection should include a visual check of the packaging for any signs of damage, tampering, or mishandling during transit.
Unpacking and Product Inspection: Upon acceptance of the shipment, customers should carefully unpack and inspect the contents to ensure that all items are in their expected condition and correspond to the packing list provided. This includes checking for any damages, missing items, or discrepancies with the order.
Reporting Damages or Discrepancies:
- Immediate Reporting: It is imperative that any damages or missing items are reported to our customer service team and freight company right away, at the time of delivery. This immediate action is crucial for a swift resolution.
- Documentation on Shipping Documents: Customers must document any damages or discrepancies directly on the shipping documents in the presence of the freight carrier's representative. This step is essential for validating the claim with the carrier and serves as immediate proof of the condition in which the goods were received.
- Photographic Evidence: In addition to noting issues on the shipping documents, customers are encouraged to take photographic evidence of any damages or discrepancies. These photographs will further support the claim process and assist in the swift resolution of any issues.
- Contacting Customer Service: After documenting the issues on the shipping documents and taking photographs, customers should contact our customer service team to report the incident. Providing a detailed account of the damages or discrepancies, along with the evidence gathered, will enable us to assist effectively.
Customer Acknowledgment: By accepting delivery of their shipment, customers acknowledge their responsibility to conduct a thorough inspection and report any issues as per the guidelines provided. This proactive approach is essential for a timely and effective resolution of any shipping-related concerns.
